After the new law on mobilization comes into force on May 18, heads of enterprises will be responsible for the non-appearance of their conscripted employees at the TCC. This was announced by Oleksandr Fediyenko, a member of the Verkhovna Rada Committee on National Security, Defense and Intelligence, during a telethon.
“The following mechanism works until May 18. Indeed, the manager issues an order to notify such an employee and can send this order to the TCC, and thus disclaims responsibility. That is, the manager does not answer whether the employee will go to the TCC or not, or whether he will - he has fulfilled his part of the legal issue by notifying the conscripted employee by issuing an order...” - he said.
And after May 18, the legal responsibility for the delivery of such an employee will be transferred to the head of the enterprise.
“I would like to emphasize that it is not clear from the Cabinet of Ministers' resolutions how this will work in practice. I think that some additional mechanisms will be finalized and developed. But I think that legally it will just be a further transfer of responsibility to the manager. That is, relatively speaking, when a manager receives an order and a list of summonses for the company's employees, the manager is obliged to issue these summonses for signature and ensure the further appearance of these conscripted employees to the relevant recruitment center. this official is subject to appropriate administrative liability,” said Oleksandr Fediyenko.
