Prohibition of driving for evaders in the law on mobilization: what is provided for?

The draft law on mobilization, which has already been prepared for the second reading in the Verkhovna Rada, contains provisions regarding the ban on driving vehicles, but with two exceptions. 


The draft law states that the right to drive can be restricted after a request from the TCC. This happens for the period until such a person fulfills the requirement to fulfill his or her duty (obligations) as a person liable for military service or a reservist.


The authors propose to supplement Article 283-2 "Peculiarities of Proceedings in Cases Upon Appeal of the Territorial Center for Recruitment and Social Support" with the following provision:

 

"Proceedings in cases at the request of the territorial center for recruitment and social support in the exercise of its statutory powers are carried out on the basis of an application for temporary restriction of an individual's right to drive vehicles - for the period until such person fulfills the requirement of the territorial center for recruitment and social support to fulfill the duty (obligations) of a person liable for military service or a reservist."

 

Restrictions on driving a vehicle are also mentioned in Part 4 of Article 23 "Measures of Influence".

 

"If a citizen voluntarily fails to fulfill the obligation specified in the request within 10 calendar days from the date of delivery of the request or fails to appear at the relevant territorial center for recruitment and social support (foreign diplomatic institution of Ukraine if the citizen is abroad), the territorial center for recruitment and social support applies to the court in accordance with the procedure established by law for a temporary restriction of such a citizen's right to drive vehicles for the period until the request is fulfilled."

 

MP Oleksiy Honcharenko also published an updated draft law No. 10449 on his Telegram channel, which specifies exceptions when tax evaders cannot be deprived of the right to drive a vehicle:

  • if the imposition of the relevant restriction deprives the person of the main legal source of livelihood;
  • the use of a vehicle by a person in connection with a disability or the dependency of a person with a disability of group I, II, recognized in accordance with the established procedure, or a child with a disability.

 

In addition, Ukrainians who have more than one vehicle may have it mobilized for the needs of the Armed Forces. Such a provision is in the draft law on mobilization submitted to the Rada. This was reported by MP Bezuhla.
