The Rada plans to deprive those who evade military service of their citizenship

Evading military service in full mobilization of Ukraine is punishable by law. Now the law "On mobilization" prescribes fines and correctional labor for up to two years. But people's deputies want to toughen the punishment for evaders, up to deprivation of citizenship of Ukraine.

 

This is stated in the bill #7205, which has already been registered in the Verkhovna Rada. For draft evasion in Ukraine is now possible to receive a fine of 300 to 500 untaxed minimum incomes of citizens or correctional labor for up to one year - Article 337 of the Criminal Code of Ukraine.

 

For persons liable for military service and reservists the fines for evading training (special) charges are higher - up to 11900 hryvnia or correctional labor for up to 2 years. For evasion from conscription during mobilization the punishment is imprisonment for the term from 3 to 5 years - Article 336 of the Criminal Code of Ukraine.

 

In the new draft law #7205 people's deputies propose to toughen the punishment for evaders who run away from mobilization abroad. In particular, MPs propose to deprive such citizens of citizenship.

 

Also during martial law it is proposed to deprive the citizenship of those who went to the country, which commits military aggression against Ukraine. Also, those who are liable for military service, who left the country and did not return within 30 days (except for business trips in order to perform functions/assignments from the central authorities).

 

Citizenship can also be deprived of those who, because of religious or other beliefs, have refused in writing to be called up for military service.

 

The executive director of the Institute of Legislative Ideas, Martina Boguslavets, said in the Lb.ua news and analysis website that according to Article 25 of the Constitution of Ukraine and the Law of Ukraine "On Citizenship of Ukraine", it is prohibited to deprive citizens of Ukrainian citizenship.

 

There are also nuances about such a procedure because human rights are violated. During the month of war, thousands of Ukrainians were forcibly removed to the Russian Federation. And the reason many Ukrainians left the country could have been a serious illness or the need for surgery.
